1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and CYNAPSEAI TECHNOLOGIES PRIVATE LIMITED ("Cynapse AI," "we," "us," or "our") concerning your access to and use of the Cynapse AI platform and services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

2. Eligibility

8. AI and Machine Learning

Our Services use artificial intelligence and machine learning technologies. You acknowledge that:

• AI-generated outputs may contain inaccuracies or errors
• You are responsible for reviewing and validating AI outputs
• We use data to train and improve our AI models, subject to our Privacy Policy
• AI performance may vary and is not guaranteed

10. Warranties and Disclaimers

We do not warrant that the Services will meet your requirements or that any errors will be corrected.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CYNAPSE AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or data
• Business interruption
• Loss of goodwill
• Cost of substitute services

Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Cynapse AI and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the Services, violation of these Terms, or infringement of any rights of another party.

13. Termination

You may terminate your account at any time by following the account deletion process in your settings or contacting us.

13.2 By Us

We may suspend or terminate your account immediately if you violate these Terms or for any other reason at our sole discretion.

13.3 Effect of Termination

Upon termination, your right to use the Services will immediately cease. We may delete your data in accordance with our data retention policies.

14. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

14.2 Jurisdiction

Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts in Bangalore, India.

16.4 Assignment
